Terms of Service

These terms are an agreement between you and Quest Club, run by its developer Miguel Angel Morales, an individual in Los Angeles, California ("Quest Club", "we", "us") for the Quest Club app, website and games (the "Service"). By creating an account or playing, you agree to them. If you do not agree, do not use the Service.

1. Who can play

You must be at least 13 years old. If you are under 18, a parent or guardian must agree to these terms and approve any purchase. You must give your real birthday when you sign up.

2. Your account

• One account works in every Quest Club game. Keep your password secret and do not share your account. You are responsible for what happens on it.
• Your username is your character's name in every game. It must not be offensive, misleading or someone else's name.
• Add an email so you can reset your password. Without one, we cannot recover a lost account.
• You can delete your account at any time. See Delete your account.

3. Games and purchases

• Some games are free. Other games, and some packs, are one-time purchases. The price is shown before you buy.
• Purchases are made through Apple's App Store (and later other stores) and are subject to that store's terms. We do not see your payment details.
• A purchase unlocks the game or pack for your account, on any device you log in to, for as long as the game is offered and your account is in good standing. It is a licence to play, not ownership of the game's code or content.
• Refunds are handled by the store you bought from. If a purchase is refunded or reversed, we may lock what it unlocked.
• We may change prices for future purchases, and may change, update or retire a game. If we retire a game you bought, we will give notice and, where we can, a way to keep playing or a fair remedy.
• Items and coins inside a game have no cash value and cannot be sold or traded outside the game.

4. How you may use the Service

You agree not to:

• cheat, hack, reverse engineer, scrape or interfere with the Service, or use bots or exploits;
• harass, threaten, bully or impersonate anyone, or post hateful, sexual, violent or illegal content, in chat or your username;
• share personal information about yourself or others in chat;
• sell, trade or share accounts, or buy anything with a payment method you are not allowed to use;
• break the law, or help anyone else do so, with the Service.

We may filter, remove or review content, and may warn, mute, suspend or ban accounts that break these rules or put others at risk. Serious or repeated breaches can lead to permanent removal without a refund of items that account unlocked. You can report a player or a problem at support@getquestclub.com.

5. Our content

The games, art, music, writing, code and the Quest Club name belong to us or to the creators who license them to us, and are protected by copyright and other laws. Credits for the art and sound a game uses are shown on the game's page. You may play the games for your own personal, non-commercial use. You may not copy, sell or reuse their content, and may not use our name or logo without permission.

If you send us feedback or ideas, we may use them without owing you anything.

6. Changes and availability

We may update the Service, and we may change these terms. If a change matters, we will tell you in the app or by email before it applies. Using the Service after that means you accept it. The Service may be unavailable at times for maintenance or reasons beyond our control, and we cannot promise it will always be error free.

7. Ending

You can stop using the Service and delete your account at any time. We may suspend or end your access if you break these terms or the law, or if we stop offering the Service. Sections that by their nature should survive (such as 5, 8 and 9) do.

8. Disclaimers and limits

The Service is provided "as is" and "as available", without promises about uptime, that it will meet your needs, or that your progress will never be lost (though we back up regularly). To the extent the law allows, we are not liable for indirect or consequential losses, and our total liability for any claim is limited to the greater of the amount you paid us in the last 12 months or US$50. Nothing here limits rights you have by law that cannot be limited, including for death or personal injury caused by negligence, or for fraud.

9. Law and disputes

These terms are governed by the laws of the State of California, without regard to conflict of law rules. Courts in Los Angeles County, California, have jurisdiction, except where your local law gives you the right to go to court where you live. Before filing a claim, please email us so we can try to fix it.
